TERMS OF SERVICE

1. Introduction and Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you and House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP", "we", "us", or "our"). By accessing or using any of our websites, platforms, or services, you agree to be bound by these Terms.

For Advertisers (including agents, builders, and developers), these Terms also include the Listing Agreement, which is incorporated by reference. In the event of any inconsistency between these Terms and the Listing Agreement regarding listing specifics, the Listing Agreement shall prevail.

These Terms apply to all HALP platforms, including www.halp.com.au and www.boutiquedevelopments.com.au and related websites and features.

By accessing or using our services, you acknowledge that you have read and understood these Terms, agree to be bound by them and our Privacy Policy, represent that you are at least 18 years of age, and represent that you have authority to enter into this agreement.

We reserve the right to modify these Terms at any time; material changes will be notified and prominently displayed.

2. Description of Services

HALP operates specialized property discovery and business directory platforms providing property services (house and land package listings, off-the-plan property information, new development project details, school zone integration, calculators, mortgage broker connections and market insights) and business directory services (professional listings, enhanced visibility, lead generation and profile management).

HALP is an information and advertising platform. Property listing inquiries go directly to the listing agent, developer or builder — HALP does not store or process property-specific inquiries. Inquiries via our platform forms (Contact Us, Join Us, Advertise With Us) are collected and managed by HALP in our CRM systems (Pipedrive, ActiveCampaign, Google Drive).

HALP is not a real estate agent, developer, builder or financial advisor and does not create an agency relationship. Services are provided "as is" and "as available".

3. User Accounts and Registration

You must provide accurate information, keep credentials confidential, be at least 18, and hold a valid ABN/ACN for business accounts. You are responsible for account activity and security. We may suspend or terminate accounts for breach, fraud, false information or non-payment.

4. User Conduct and Prohibited Activities

You must comply with all laws, use services only for lawful purposes, provide accurate information and respect intellectual property. You must not misuse the platform (bots, scraping, unauthorized access, reverse engineering), post harmful content, conduct illegal activities, harass or abuse others, or misuse the platform commercially. Violations may result in suspension, removal, legal action or referral to law enforcement.

5. Property Listings and Information

Property listings are third-party content. HALP does not verify all listing information, endorse providers, or guarantee availability or pricing. Prices, specifications and school zones may change without notice — always verify critical information directly with the property provider and the relevant education department before making decisions.

6. Business Directory Listings

Advertisers must hold a valid ABN/ACN, comply with all applicable laws, and provide accurate information. Listings must not promote illegal goods, make false claims, violate professional codes or contain discriminatory content. Free and Premium subscriptions are subject to acceptance, payment and separate subscription terms. We may remove listings for breach.

7. Payment Terms (Advertiser Subscriptions)

Pricing is displayed on our website or in the applicable Listing Agreement and may change with 30 days notice. Fees are in AUD and displayed exclusive of GST unless otherwise stated. Payments are processed via Stripe (PCI-DSS Level 1 certified). Subscriptions auto-renew unless cancelled. Refunds are generally not issued for voluntary cancellations, but pro-rata refunds apply for technical issues preventing service access, processed within 14 business days. Non-payment may lead to suspension after 7 days and listing removal after 14 days.

8. Intellectual Property Rights

All content and materials on our platforms are owned by HALP or licensed to us — including logos and trademarks ("HALP", "House And Land Packages", "Boutique Developments"), website design, software, text, graphics and databases. We grant users a limited, non-exclusive, non-transferable licence for personal, non-commercial use. Copyright infringement claims: legal@halp.com.au.

9. Disclaimers and Limitations

HALP does not provide financial, mortgage, legal, tax or real estate advice. Calculators and tools provide estimates only. Data may contain errors or become outdated. We do not guarantee continuous, uninterrupted access.

10. Limitation of Liability

To the maximum extent permitted by law, HALP is not liable for direct, indirect, consequential or incidental damages. Where liability cannot be excluded, our total liability is capped at $100 AUD for free services, or for paid services the lesser of $1,000 AUD or the amount you paid us in the 12 months prior. Nothing in these Terms excludes rights under the Australian Consumer Law.

You agree to indemnify HALP for claims arising from your breach of these Terms, violation of law or third-party rights, use of our services or content you submit.

11. Dispute Resolution

Before legal proceedings, contact legal@halp.com.au and allow 30 days for informal resolution. These Terms are governed by the laws of New South Wales, Australia, with exclusive jurisdiction in NSW courts. Optional arbitration in Sydney is available under ADRA rules. Class actions are waived to the extent permitted by law.

12. General Provisions

These Terms constitute the entire agreement. If any provision is invalid, the remainder continues in effect. Our failure to enforce any provision is not a waiver. 13. Special Terms for Specific Services

Mortgage calculators provide estimates only, not pre-approvals. School zone data is provided "as is" — always verify with the relevant state education department and the school. Property alerts are opt-in and can be modified anytime. Home loan referrals may attract referral fees; brokers are independent third parties.
